Mit der Teilnahme an den von „Le Timbre Classique SA“ organisierten Auktionen akzeptieren Sie alle unsere nachstehenden Bedingungen sowie die sich daraus ergebenden Rechte und Pflichten.

 

  1. Wir garantieren die Echtheit der einzelnen Lose (Briefmarken, Briefumschläge und verwandtes Material), für einen Zeitraum von 5 Jahren. Lose, die aus mehreren Briefmarken oder Briefen bestehen, die nicht einzeln beschrieben sind, sind von dieser Garantie ausdrücklich ausgeschlossen.
    Die Unterbreitung eines Angebots für ein Einzellos mit einem Attest oder mit einer Unterschrift bedeutet die Annahme dieses Gutachtens durch den Käufer und schließt dieses Los von jeglichen Ansprüchen aufgrund des Gutachtens eines anderen Experten aus. Wenn der Käufer den Rat eines anderen Experten wünscht, muss er uns dies spätestens am Tag der Auktion mitteilen.

    1. Die Lose können entweder in unseren Büros oder am Ort der Auktion zu den im Katalog oder auf unserer Webseite genannten Zeiten besichtigt werden.
    2. Der Kunde ist für alle Schäden verantwortlich, die beim Umgang mit den Briefmarken entstehen.
    3. Nur der bei unserem Unternehmen registrierte Kunde oder sein registrierter Vertreter kann an unseren Auktionen teilnehmen.
    4. Wir können jederzeit ein Los zurückziehen oder zwei oder mehrere Lose zusammenfassen.
    5. Wir können die Teilnahme eines Kunden an unserem Verkauf oder unserer Auktion jederzeit ohne Angabe von Gründen ablehnen.
  1. Die Fotos der Lose in unseren Katalogen oder auf unserer Webseite sind Teil der Beschreibungen: Zähnung, Ränder, Zentrierung, Abstempelungen, Farben usw.
    1. Eine Reklamation (für ein Einzellos) bezüglich der Qualität, eines Beschreibungsfehlers oder einer anderen Anforderung muss uns bei Erhalt der Ware mitgeteilt werden, jedoch immer innerhalb von 30 Tagen nach dem Verkauf.
      Andernfalls verliert der Kunde das Recht auf jegliche Rückgabe oder Berichtigung.
      Wir akzeptieren keine Beschwerden über Sammlungen oder Lose, die aus mehreren Briefmarken oder Briefen bestehen.
      Wir akzeptieren keine Rückgabe von großen oder gemischten Losen, wenn der Käufer die Möglichkeit hatte, sie persönlich oder durch einen Vertreter zu begutachten
      Wir akzeptieren keine Rückgabe des Loses, wenn es vom Käufer absichtlich verändert wurde.
    2. Jeder Antrag auf ein Gutachten (nur für ein Einzellos) muss während der Auktion oder spätestens 2 Wochen nach dem Verkaufstag gestellt werden.
      Eine Rückgabe oder Änderung auf der Grundlage eines Gutachtens, das der Käufer nach Erhalt seiner Waren, aber ohne unsere Zustimmung erhalten hat, wird nicht akzeptiert.
  1. Alle Auktionsgebote müssen in CHF abgegeben werden (sofern in den Katalogen und / oder auf der Webseite nicht anders angegeben).
    1. Bitte beachten Sie bei Geboten oder Angeboten die folgenden Gebotsschritte:
      von CHF 50 bis CHF 200 = CHF 10
      von CHF 200 bis CHF 500 = CHF 20
      von CHF 500 bis CHF 1’000 = CHF 50
      von CHF 1’000 bis CHF 2’000 = CHF 100
      von CHF 2’000 bis CHF 5’000 = CHF 200
      von CHF 5’000 à CHF 10’000 = CHF 500
      de CHF 10’000 à CHF 20’000 = CHF 1’000
      de CHF 20’000 bis CHF 50’000 = CHF 2’000
      von CHF 50’000 bis CHF 100’000 = CHF 5’000
      über CHF 100’000 = CHF 10’000
      Wir werden Gebote, die nicht in Übereinstimmung mit den Schritten der obigen Skala stehen an den NÄCHSTHÖHEREN SCHRITT anpassen.
    2. Falls wir zwei identische Gebote oder Angebote für dasselbe Los erhalten, wird das Los demjenigen zugeschlagen, der zuerst eintrifft.
    3. Eine Person (Agent, Vertreter), die im Namen einer dritten Partei bietet, ist für die Bezahlung der Waren verantwortlich.
    4. Verkaufserlös: Auf den Zuschlagpreis wird eine Kommission von 22% sowie 1% Versicherung und die schweizerische Mehrwertsteuer von 7,7% aufgeschlagen.
      Ausländische Kunden, die selbst exportieren möchten, müssen die schweizerische Mehrwertsteuer bezahlen und erhalten die schweizerische Mehrwertsteuer gegen Vorlage des offiziellen Exportdokuments am Schweizer Zollamt zurück.
      Für unsere Kunden, die im Ausland wohnen, exportieren wir die Ware und deklarieren den auf der offiziellen Rechnung ausgewiesenen Betrag (dieser ist in Schweizer Franken).
  2. Bezahlung der Ware: Die Zahlung ist am Tag des Verkaufs fällig.
    1. Wir akzeptieren einen Zahlungsverzug nur bei Losen, die begutachtet werden sollen.
    2. Wir akzeptieren Zahlungen in einer anderen Währung, sofern der angewandte Wechselkurs von unserem Unternehmen angegeben oder vereinbart wurde. Der Käufer ist für jede Wechselkursdifferenz verantwortlich, wenn er keine ausdrückliche Anfrage oder Vereinbarung über den Wechselkurs mit unserem Unternehmen gemacht hat.
    3. Wir liefern die Waren, sobald wir den vom Käufer geschuldeten Betrag in voller Höhe erhalten haben.
    4. Alle ohne triftigen Grund an uns zurückgesandten Waren werden gegen Zahlung einer neuen Versandrechnung und anderer damit verbundener Kosten erneut versandt.
    5. Alle nicht vollständig bezahlten Waren bleiben Eigentum des Verkäufers.
      Wenn der Kunde nach dreimaliger Mahnung seine Schulden nicht vollständig beglichen hat, behält Le Timbre Classique SA die bereits gezahlten Beträge als erste Entschädigung ein.
  1. Zahlungsverzug: Eine Gebühr von 40 CHF pro Mahnung sowie eine Strafe von 5% des Rechnungsbetrags am 30. Tag nach dem Verkauf, danach 2% der fälligen Beträge pro angefangenen weiteren Monat.
  2. Anwendbares Recht und Gerichtsstand: Der Verkauf und alle sich daraus ergebenden Rechtsstreitigkeiten unterliegen ausschliesslich schweizerischem Recht.
    Jede Klage gegen einen schweizerischen oder ausländischen Käufer unterliegt der ausschliesslichen Gerichtsbarkeit der Gerichte in Genf, vorbehaltlich der Berufung an das Schweizerische Bundesgericht in Lausanne.
  1. Unser Unternehmen ist nicht versichert und übernimmt keine Haftung für :
    Personen- oder Sachschäden, die auf dem Weg zum Büro oder zum Verkaufsort entstehen.
    Körperverletzung an der Verkaufsstelle.

Conditions of Sale Participation in sales organised by „Le Timbre Classique“ means that you accept all of our conditions below as well as the rights and obligations arising therefrom.

  1. We guarantee the authenticity of individual lots (stamps, covers and related material not limited to proofs, essays and specimens) for a period of 5 years. Lots composed of several stamps or letters which are not individually described are specifically excluded from this guarantee.

The submission of an offer on an individual lot with an expert’s certificate or signature signifies the buyer’s acceptance of this expertise and excludes that lot from any claims based on the opinion of another expert. If the buyer wants the advice of another expert, he must inform us with his offer. 1.1 The lots can be viewed either in our offices or at the place of sale, at the times mentioned in the catalogue or on our website. 1.2 The customer is responsible for all damage caused while handling the stamps. 1.3 Only the customer registered with our company may participate in our sales. 1.4 We may withdraw a lot or group two or more lots at any time. 1.5 We may at any time refuse the participation of a client in our sale or auction without giving any justification.

  1. The photos of the lots in our catalogues or on our site are part of the descriptions: perforations, margins, centring, cancellations, colours, etc.

2.1 A reclamation (for an individual lot) concerning the quality, an error of description or any other request, must be notified to us upon receipt of the goods, but always within 30 days after the sale. Otherwise, the customer loses the right to any return or adjustment. We do not accept reclamations about collections or lots made up of several stamps or covers. We do not accept a return of large or mixed lots if the buyer has had the opportunity to examine them personally or through an agent. We do not accept the return of a lot if it has been intentionally altered by the buyer. 2.2 Any request for an expertise (only for an individual lot) must be made during the sale, or at most 2 weeks after the day of the sale. A return based on any expertise obtained by the buyer upon receipt of his goods, but without our approval, will not be accepted.

  1. All auction bids must be made in EURO. There is no buyer’s commission.
  • The lots will go to the bidder with the highest offer at the price of the second highest offer plus 5%. Example : We receive three offers for a same lot : 150, 200 et 225 euros. The lot will go to the bidder having made the offer of 225 euros 200 + 5% (10 euros) = 210 euros.
  • If the difference between two offers is less than 5%, then the higher offer will be taken into account. In the case of a single bid, the 5% will be calculated on the start price
  • In the event that we receive two identical bids or offers for the same lot, we will award the lot to the one that arrives first.
  • The lots will be sent by registered mail. 1% will be charged as insurance costs. Should this 1% not be paid by the buyer, the sending will be sent at the risk of the buyer. The mailing costs comprise postage, handling and list of results. These costs are 10 euros for France and 15 euros for sendings going abroad. A supplement of 10 euros will be charged for sending above 2000 euros. For large sendings, the effective costs will be charged
  1. Payment for the goods: payment is due on the day of the sale.

4.1 We accept a payment delay only on lots to be expertised. 4.2 We accept payment in another currency, provided that the exchange rate applied is indicated or agreed by our company. The buyer will be responsible for any exchange rate difference if he has not made an express request or agreement for the exchange rate with our company. 4.3 We will deliver the goods once we have received the full amount owed by the buyer. 4.4 Any goods returned to us without valid reason will be reshipped against payment of a new shipping invoice and other related costs. 4.5 Any goods not paid in full will remain the property of the seller. 4.6 If after sending three reminders, the customer has not paid his complete debt, Le Timbre Classique will keep any amounts already paid as initial compensation. 5. Late payment: A charge of EUR 40 per reminder, as well as a penalty of 5% of the total invoice on the 30th day after the sale, then 2% of the sums due per additional month or portion thereof. 6. Certificates for items with a value of more than 400 euros can be obtained upon request at no extra charge. For lots under 400 euros, a participation of 10 euros will be charged. 7. Applicable law and jurisdiction: The sale and all resulting legal actions arising therefrom will be subject to French law only. Any action against a French or a foreign buyer will be subject to the exclusive jurisdiction of the courts of Paris. 8. Our company does not insure and assumes no liability for: – Personal injury or material damage occurring during the journey to the office or to the place of sale. – Bodily injury at the point of sale.
